Michigan Small Business Association challenges CTA! The Michigan SBA filed litigation in the U.S. District Court, Western District of Michigan (Grand Rapids) on March 26 challenging the constitutionality of the Corporate Transparency Act. The Act was previously ruled to be unconstitutional by the Federal court of Northern Alabama; FinCEN acknowledged the ruling but stated it only exempted members of the class at that time (members of the National Small Business Association). Both cases are similar in that the plaintiff's filings contend the CTA is unconstitutional as it requires disclosure of sensitive and personal data, including addresses, drivers licence numbers, passport numbers, and photographs, while the party has not been accused of a crime, a violation of the 4th amendment. Whether this case will be successful remains to be seen, but if not it could cause an appeal to the U.S. Supreme Court.
