Agree with everything in the above here. I would also add that the other side needs to FEEL like they got a “win,” and your own client needs to know that they have to feel this too. I often explain to my clients that the opposition’s attorney needs to report good news to THEIR client. So I ask “what can we do to enable that lawyer to give her client good news?” I even tell that lawyer, “Hey I know you need to tell your client something good. What if we [insert concession here].” This is a tactic that not only gets everyone to a win-win, it makes the process more pleasant because it shows that attorney that I’m considering THEM as well. We all get along and deals get done without drama.
