Very pleased to have received this published Appellate Division decision today issued in favor of my client, a 75-year old owner of a commercial property in Paterson, New Jersey who stood to lose his entire investment over what started out as a mere $606 of unpaid sewer tax liens dating back 11-years ago. The property was unencumbered by a mortgage and was worth in excess of $475,000. The trial court vacated the tax sale plaintiff's foreclosure judgment conditioned on my client's payment of the unpaid taxes, which had ballooned to over $40,000, plus reimbursement of the plaintiff's legal fees. My client satisfied these conditions and title to the property was restored to him. The plaintiff then appealed. The Appellate Division's decision is very important because the court ruled that the U.S. Supreme Court's recent decision (Tyler vs. Hennepin County) - which had overturned a public government's tax foreclosure judgment that deprived the property owner of her equity on the grounds that it constituted an unlawful taking in violation of the 5th Amendment - applies equally to private tax foreclosure cases under New Jersey's existing tax foreclosure statutes. #taxattorney #realestateattorney #foreclosure #realestate #taxes #municipalities #supremecourt #appellatelaw #appeals #newjerseyrealestate #newjerseybusiness #njlawyer

Partner Glenn Reiser argued an important appeal yesterday before a 3-judge panel of the New Jersey Appellate Division in a case involving a commercial real estate tax appeal. At issue, is whether the trial court acted appropriately in vacating a tax plaintiff's foreclosure judgment and permitting my client the opportunity to redeem or pay off the tax lien and avoid the disastrous loss of his property valued at almost 17 times higher than the tax lien. The case is also significant because the Appellate Division is considering whether the US Supreme Court's recent decision in Tyler v. Hennepin County impacts the issues on appeal. The case on appeal is 257-261 Avenue Realty, LLC v. Roberto, Docket No. A-3315-21.
